Les corps des personnes qui meurent dans le contexte d’un conflit armé ou de situations de violence n’atteignant pas le seuil d’un conflit armé – ou qui perdent la vie au cours d’une catastrophe ou d’une migration – doivent être traités avec respect, leur dignité doit être protégée, et les restes des personnes décédées inconnues doivent être identifiés. Lorsque les obligations énoncées dans le droit, tant international que national, en matière de traitement des morts ne sont pas respectées, ou lorsque les standards internationaux et nationaux pertinents ne sont pas atteints et que les politiques et pratiques nécessaires ne sont pas mises en œuvre, il peut en résulter une augmentation du nombre de personnes portées disparues. De plus, cela peut dénoter un manque de respect pour les morts ainsi que pour les droits et les besoins de leurs familles, dont la souffrance se trouve ainsi prolongée.

Le droit international humanitaire (DIH) est un ensemble de règles qui s’applique en situation de conflit armé. Il vise, pour des raisons humanitaires, à protéger les personnes qui ne participent pas – ou plus – directement aux hostilités, et à restreindre les moyens et méthodes de guerre. Le traitement des morts au cours d’un conflit armé a toujours fait l’objet de préoccupations culturelles et religieuses. C’est également une problématique dont le DIH traite depuis longtemps. Il exige en particulier que les restes des personnes décédées au cours d’un conflit armé soient pris en charge correctement et dans le respect de leur dignité. Il exige aussi des parties qu’elles recherchent, recueillent et évacuent les morts, afin d’éviter qu’ils soient portés disparus.

D’autres branches du droit international, telles que le droit international des droits de l’homme et le droit international des interventions lors de catastrophes, contiennent des dispositions visant à assurer une prise en charge correcte des dépouilles et le respect de la dignité des morts. D’autres dispositions de ces corpus de droit visent à élucider le sort des personnes portées disparues non seulement dans le contexte d’un conflit armé mais aussi dans des circonstances telles que celles qui sont mentionnées plus haut.

 

Humanity after life: Respecting and Protecting the Dead

 

When people die during armed conflicts, situations of violence falling below the threshold of armed conflict, disasters, or while migrating, their bodies must be handled respectfully and with dignity; and the remains of unknown individuals must be identified. Lack of respect for international and domestic obligations and poor adherence to international and national standards, policies, practices on managing the dead can increase the number of missing persons, disrespects the deceased person and the rights and needs of their relatives and prolongs their suffering.

International humanitarian law (IHL) is a set of rules that applies in times of armed conflict and seeks – for humanitarian reasons – to protect persons who are not, or are no longer directly participating in hostilities, and to restrict means and methods of warfare. Throughout history, the treatment of the dead in times of armed conflict has been a subject of concern, pronounced on by all cultures and religions. IHL has also a long history of regulating the respect for and protection of the dead. In particular, IHL requires that the remains of those who have died during an armed conflict be handled with dignity and be properly managed. It also requires that they be searched for, collected and evacuated, which helps ensure that people do not go missing.

Other branches of international law such as international human rights law and international disaster response law, contain important provisions to ensure that the dead are managed in a proper and dignified manner and to clarify the fate and whereabouts of missing persons not only in armed conflicts but also in other circumstances such as the ones mentioned above.
